How Does Workers' Compensation Affect Social Security Disability Benefits?

Individuals who have been injured at work in Pennsylvania, West Virginia or Ohio are typically eligible to receive workers' compensation benefits through their state's workers' compensation insurance system. Upon approval of the state's workers' compensation award, the injured worker will also apply for Social Security Disability Insurance (SSDI) through the federal program, as well. In Pennsylvania and West Virginia, the Social Security payments will often be reduced if a person is also receiving workers' compensation. In Ohio, the workers' compensation benefit will be reduced if a person receives Social Security payments.

Under rules of the federal SSDI, applicants must show that they have been unable to work for a minimum of 12 months prior to receiving benefits. This does not mean you must wait one year before applying. As soon as you believe that you will be unable to return to work for an extended amount of time, it is important to apply. If you return to work, you may qualify for SSDI benefits for the months you were off the job.
