Appeal Your Denial
In Pennsylvania you have 60 days from the date on your decision letter to file your appeal. This is also known as a Request for Hearing or Request for Review.
In Ohio and West Virginia, you have 60 days from the date on your decision letter to file your Request for Reconsideration.
Social Security Disability Hearing
Your hearing will probably be scheduled 15 to 18 months from the date that you filed your Request for Hearing. The waiting time varies depending upon how far behind the hearing office is.
The Social Security Disability process from application to hearing to a decision by the Administrative Law Judge usually takes between 18 and 24 months. The process is slow and difficult. There is extensive backlog at the Office of Disability Adjudication and Review. It is so important to apply for benefits as soon as you become disabled because it may be two years before you are receiving benefits.
While You Wait.
While you are waiting for your Social Security Disability hearing to be scheduled it is important that you continue seeing your doctors and therapists. You should follow the advice of your doctor during this time.
If Berger and Green represent you, we ask that you keep us updated regarding any change in your medical conditions. This includes new doctors, changes in prescription medication, and any hospital stays.
Prior to the hearing Berger and Green will order medical records so that the records of your medical treatment will be complete for your hearing.
